2.3 Harmful or Dangerous Content
- Content that promotes or glorifies violence, terrorism, or extremism
- Instructions for creating weapons, explosives, or dangerous devices
- Content that encourages self-harm or suicide
- Graphic violence or gore (except in legitimate news or educational contexts)
2.4 Hateful or Harassing Content
- Hate speech targeting race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Harassment, bullying, or threats
- Doxxing (publishing private information without consent)
- Content that incites violence or discrimination
2.5 Deceptive or Fraudulent Content
- Phishing, scams, or fraudulent schemes
- Pyramid schemes, multi-level marketing (MLM), or "get rich quick" schemes
- Fake news, misinformation, or impersonation
- Counterfeit goods or unauthorized merchandise
2.6 Regulated or Restricted Content
- Sale of illegal drugs, controlled substances, or drug paraphernalia
- Sale of tobacco, vaping products, or e-cigarettes (without proper licensing)
- Sale of weapons, firearms, ammunition, or explosives (without proper licensing)
- Gambling or betting services (without proper licensing and compliance)
- Cryptocurrency services that violate regulations (unlicensed exchanges, unregistered securities)
- Pharmaceutical sales (without proper licensing)
3. Prohibited Activities
You may not use our Services to:
3.1 Fraud and Financial Crimes
- Engage in fraudulent transactions or money laundering
- Process payments for prohibited or illegal goods/services
- Engage in credit card fraud, identity theft, or payment fraud
- Manipulate or abuse refund or chargeback processes
- Create fake accounts or use stolen credentials
3.2 Spam and Abuse
- Send unsolicited bulk emails (spam) or SMS messages
- Scrape, harvest, or collect user data without permission
- Use automated tools (bots, scrapers) to access our Services without authorization
- Engage in SEO manipulation, link schemes, or "black hat" tactics
3.3 Security and Technical Abuse
- Hack, breach, or compromise our systems or user accounts
- Distribute malware, viruses, ransomware, or other malicious code
- Conduct denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
- Circumvent security measures, rate limits, or access controls
- Reverse engineer, decompile, or disassemble our software
3.4 Resource Abuse
- Use excessive bandwidth, storage, or computing resources
- Run cryptocurrency mining operations without explicit permission
- Host proxy servers, VPNs, or anonymization services without authorization
- Engage in activities that degrade service performance for other users
4. Payment Network Compliance
As a platform that processes payments, we must comply with the rules of payment networks (Visa, Mastercard, American Express, Discover, etc.) and payment processors (Stripe, PayPal, CCBill, etc.).
Prohibited Payment Activities:
- Transactions that violate payment network rules or regulations
- High-risk merchant categories without prior approval and compliance
- Chargebacks exceeding industry thresholds (typically 1-2%)
- Misleading billing descriptors or transaction descriptions
- Processing payments for third parties without proper authorization
- Split transactions to evade security or fraud detection measures
We reserve the right to implement additional restrictions based on payment processor requirements or changes to payment network rules.
5. Intellectual Property Compliance
You must respect the intellectual property rights of others:
- Do not upload or share copyrighted content without permission
- Do not use trademarks, logos, or brand names without authorization
- Do not create derivative works based on copyrighted materials without permission
- Respond promptly to DMCA takedown notices
We comply with the Digital Millennium Copyright Act (DMCA). If you believe your content has been infringed, contact us at legal@kjcdigital.com with:
- Identification of the copyrighted work
- Location of the infringing material
- Your contact information
- A statement of good faith belief that the use is unauthorized
- A statement that the information is accurate and you are the rights holder
6. Monitoring and Enforcement
6.1 Monitoring: We reserve the right (but have no obligation) to monitor user content and activities for compliance with this AUP. We may use automated tools, manual review, and user reports to identify violations.
6.2 User Reporting: If you encounter content or behavior that violates this AUP, please report it to legal@kjcdigital.com with details and evidence.
6.3 Investigation: We will investigate reported violations and may request additional information from you or the accused party.
7. Consequences of Violations
Violations of this AUP may result in the following actions, at our sole discretion:
- Warning: First-time or minor violations may receive a warning and request to remove content
- Content Removal: Immediate removal of violating content
- Account Suspension: Temporary suspension of your account and services
- Account Termination: Permanent termination of your account and ban from our Services
- Payment Holds: Freezing of funds pending investigation
- Legal Action: Cooperation with law enforcement or pursuit of civil/criminal action
Zero Tolerance: Certain violations (CSAM, human trafficking, terrorism, fraud) will result in immediate account termination, asset seizure, and law enforcement reporting.
8. Appeals Process
If your account is suspended or terminated for an alleged AUP violation, you may appeal by:
- Sending an email to legal@kjcdigital.com within 30 days
- Providing your account details and case reference number (if provided)
- Explaining why you believe the action was in error
- Providing any supporting evidence
We will review your appeal and respond within 10 business days. Our decision on appeals is final.
9. Cooperation with Law Enforcement
We will cooperate fully with law enforcement agencies investigating illegal activities. We may disclose user information and content in response to:
- Valid legal process (subpoenas, court orders, search warrants)
- Emergency requests to prevent imminent harm
- Investigations of serious crimes (child exploitation, terrorism, human trafficking, etc.)
10. Changes to This Policy
We may update this Acceptable Use Policy from time to time to reflect changes in laws, payment network rules, or our services. We will notify you of material changes by:
- Posting the updated AUP on our website
- Updating the "Last Updated" date
- Sending email notification for significant changes
Your continued use of our Services after changes become effective constitutes acceptance of the revised AUP.
